WHEN DID OREGON LEGALIZE CANNABIS?
Oregon was the first state to decriminalize cannabis, way back in 1973. But the journey from there to legal recreational cannabis was a long one. A number of bills and ballot measures failed over the next two decades that would have made it possible to legally possess and consume weed in the State of Oregon. It wasn't until 1998 that The Oregon Medical Marijuana Act was passed, which made it possible for Oregonians to use cannabis for medical purposes.
As for recreational cannabis, it wasn't made legal until nearly two decades later. In 2014, Measure 91 was passed. Known as The Oregon Cannabis Tax Act, it legalized cannabis for recreational adult use (those 21 and over) as well as regulating the cultivation, sales, and taxation of cannabis. At the same time, it legalized the production, sale, and possession of hemp. When the bill was signed into law by Governor Kate Brown, it set October 1, 2015 as the start date for legal sales of cannabis from dispensaries under the supervision of the OLCC.
According to the Oregon Liquor and Cannabis Commision, total cannabis sales reached $1.11 billion in 2020, up from $795 million in 2019.
WHAT ARE THE CANNABIS ADVERTISING RULES IN OREGON?
In the absence of federal regulations (technically marijuana is still illegal according to the United States), each state is left to establish its own rules governing the marketing and sales of cannabis, CBD, and hemp products. It's up to individual businesses to stay abreast of the latest rules and regulations regarding packaging, sales, transport, marketing, and more. Note that the rules change frequently, and anything written here could be out of date by the time you are reading this.
Oregon law states that the Oregon Liquor and Cannabis Commision is in charge of enforcing rules regarding the marketing of cannabis products and businesses. The marketing rules include provisions that state advertisements and marketing materials may not:
Contain statements that are deceptive, false, or misleading
Contain any content that could reasonably be considered to target people under the age of 21
Encourage the transportation of cannabis products across state lines
Assert that cannabis is safe because it is regulated by the Commission or has been tested by a certified laboratory
Make claims that recreational cannabis has curative or therapeutic effects
Display consumption of cannabis items
Encourage the use of cannabis because of its intoxicating effect
Encourage excessive or rapid consumption
This is just a taste of what the rules cover, and they tend to be both extensive and confusing, as anyone operating in the Oregon market understands too well. That's why it is strongly recommended that businesses have a well-informed compliance officer who works closely with the marketing team to stay abreast of what's allowed and what isn't. When in doubt, err on the side of caution.
