IS CANNABIS LEGAL IN FLORIDA?

Medical marijuana was made legal in 2014, when the Florida Legislature passed the Compassionate Medical Cannabis Act. The new law makes it permissible for seriously ill patients suffering from cancer or epilepsy to consume cannabis. Patients must apply for Registry Identification Cards and purchases must take place at authorized Medical Marijuana Treatment Centers. Other provisions allow for patients or caregivers to procure up to a 35-day supply of smokeable flower, or a 70-day supply of medical cannabis in other forms (such as edibles). Other viable intake options include sprays, oils, vaping, or pills.

Legal medical dispensaries, known as MMTC's, can be found throughout the state (view map). Cannabis consumption is forbidden in public, as well as at school or work sites, or on board a car or other vehicle, including all public transportation. Likewise, driving while under the influence of cannabis is also prohibited.

Patients with the following conditions are eligible for a medical cannabis ID card:

Amyotrophic Lateral Sclerosis (ALS), (Known as Lou Gehrig's Disease)
Cancer
Crohn's Disease
Epilepsy
Glaucoma
HIV/AIDS
Multiple Sclerosis (MS)
Parkinson's Disease
Post-Traumatic Stress Disorder (PTSD)

Moreover, patients may be deemed eligible when they have been determined to have a terminal condition, chronic nonmalignant pain, or other diseases similar in nature to those already mentioned.

WHAT ARE THE CANNABIS ADVERTISING RULES IN FLORIDA?

Because Florida is a state where recreational consumption of cannabis is not allowed, cannabis businesses must adhere to strict and specific rules concerning the marketing and advertising of cannabis. Although the initial law was established with the Compassionate Medical Cannabis Act, its provisions are overseen by the Florida Department of Health. Their rules are quite strict and they oversee almost every aspect of the cultivation, licensing, distribution, and marketing process.

With the obvious exceptions of hemp and CBD, nearly the entire production and processing value chain is handled by approved medical marijuana treatment centers. They are charged with cultivating, packaging, and providing approved medical marijuana (their are strict limits regarding the THC percentage). These cannabis businesses are permitted to market and advertise themselves as long as they adhere to the following guidelines:

All advertisements must be approved by the Department of Health.
Advertisements may not reasonably be considered to be targeting people under the age of 18
Advertisements are forbidden from containing cartoon characters or anything similar.
Unsolicited pop-up advertisements are not allowed.
All opt-in marketing must have a clear and obvious opt-out feature.

Because the Florida Department of Health is so closely involved in approval and oversight, it is essential that cannabis businesses in the State of Florida maintain a strong and cordial relationship with its representatives, and strive their best to avoid being penalized.
