Although California has a long history with the cannabis plant, having operated a thriving hemp industry as early as the 18th century, it was not until the 60's beatnik and hippie movements that the growing of recreational cannabis really drew national attention. This lead to a lucrative black market centered around the Emerald Triangle in Northern California, which is recognized as the largest region of outdoor cultivation in the nation.

The Moscone Act of 1975 largely decriminalized cannabis possession, though there were still exceptions for cultivation and intent to distribute. In 1996, medical cannabis advocates helped push through Proposition 215 a statewide ballot initiative, which made it legal for patients to consume, possess, and cultivate cannabis. Ailments covered in the bill included cancer, anorexia, AIDS, spasticity, glaucoma, arthritis, migraine, and chronic pain.


As for the legalization of recreational cannabis, it wasn't until 2016 that Proposition 64 was passed, meaning that despite its long heritage of cannabis production, it actually followed a number of other states in making cannabis legal. Known as the Adult Use of Marijuana Act, it made it legal for all adults at least 21 years of age to consume cannabis.


Provisions of the bill make it legal to:

  • Possess, transport, process, purchase, obtain, or give away, without any compensation whatsoever, no more than one ounce of dry cannabis or eight grams concentrated cannabis to adults the age of 21 or older.

  • Possess, plant, cultivate, harvest, dry, or process no more than six live plants and the produce of those plants in a private residence, in a locked area not seen from normal view, in compliance with all local ordinances.

  • Smoke or ingest cannabis.

  • Possess, transport, purchase, obtain, use, manufacture, or give away marijuana paraphernalia to peoples the age of 21 or older.


The advertising regulations regarding cannabis in California were largely designated according to section 26151 of Proposition 64. One of the primary goals of the restrictions are to protect minors (in this case, anyone under the age of 21) from being marketed to. This means that it is forbidden to display any cannabis advertisement in a location where less than 71.6 percent of the audience is underage. This covers broadcast, cable, radio, print, and digital advertising. The nature of the advertisements must also avoid any type of content that might be reasonably found to be appealing to children.

The rules also make it difficult to use billboard advertising. For instance, businesses are forbidden from placing advertisements for cannabis  along any Interstate or Highway that crosses the California border. You also aren't allowed to have ads within 1,000 feet of  day care centers, schools, playgrounds, parks, libraries, youth centers, or arcades. Businesses also are prohibited from distributing coupons or offering free gifts of cannabis products.

It should be noted this is just an overview of California's cannabis, hemp, and CBD regulations.  It is highly recommended that all businesses that deal with cannabis have a full time compliance officer who ensures that all current regulations are followed. Furthermore, these rules are liable to change at anytime, so don't rely on information that may be outdated when formulating your marketing strategy for California.
